Q&A Discharge and Admit within hours

I have a pt that was being discharged from the hopsital from one physician and within a couple of hours she was admitted by a different physician. Can we use the admit/discharge code (99234, 99235, or 99235)? I thought this was a intersting situation.? If you can not bill this code could you give a reason why we could not, my boss is also interested in what the decision is?

It depends on whether the payer goes by the rule: "one EM code per physician per patient per day” OR "one EM per practice per patient per day” how this is handled.
